Abstract

The rapid growth of the cosmetics industry in Indonesia has significantly increased the circulation of cosmetic products in the market. Along with this development, the distribution of illegal cosmetics without marketing authorization has also become a serious concern, particularly in Pekanbaru City. Illegal cosmetic products potentially endanger consumers because they may contain hazardous substances, fail to meet quality standards, and are not subject to proper safety evaluations. In response to this issue, the Food and Drug Supervisory Agency (BPOM), through the Regional Office of the National Agency of Drug and Food Control (BBPOM) Pekanbaru, plays a strategic role in supervising the circulation of cosmetic products. This study aims to analyze the role of BBPOM Pekanbaru in monitoring the distribution of illegal cosmetics based on Presidential Regulation Number 80 of 2017 concerning the National Agency of Drug and Food Control, identify the obstacles encountered in implementing supervision, and examine the efforts undertaken to overcome such challenges. This research employs an empirical legal research method with a descriptive-analytical approach. Data were obtained through interviews, observations, documentation, and literature studies. The findings indicate that BBPOM Pekanbaru performs its supervisory function through pre-market and post-market control mechanisms, including inspection, sampling, testing, public education, and law enforcement actions. However, supervision remains constrained by several factors, including limited human resources, the increasing use of digital platforms for illegal cosmetic sales, low public awareness, and the broad distribution network of illegal products. To address these challenges, BBPOM Pekanbaru has intensified public education programs, strengthened inter-agency cooperation, enhanced laboratory capabilities, and optimized digital monitoring systems. The study concludes that strengthening institutional capacity and increasing public participation are essential for improving the effectiveness of illegal cosmetic supervision and ensuring consumer protection.
